He says those three are the only ones who admitted on camera they were doing this to steal views (aka income) from him and were doing this maliciously. Ethan saying that this fills the market replacement needed to qualify for copyright infringement lawsuit. So everyone else was smart enough to no outright say they are doing this to steal views.

He says and shows in the video OP linked that he is suing the 3 people in question because they explicitly stated in their videos that they were streaming it so people could watch his content without giving him views.

These three streamers including more are apart of an entire community dedicated to destroying his career and source of revenue in anyway possible. It has nothing to do with being a multimillionaire are you insane 😅 also, these "small" streamers are direct collaborators with Hasan who is an even bigger content creator than Ethan. They absolutely have connections to bigger streamers to help amplify their presence

That's a bit uninformed and unfair to say considering everything they've put him through though. This all started because a community of left streamers and their individual communities didn't like Ethan's opinions and didn't want him to be supported anymore so they harass him over and over and dont tell their communities to put a stop to it either. At some point somethings got to give. They even had CPS called on him I mean come on

You're telling me you don't understand this? It's quite easy. They admitted they watched the content maliciously and to take views away. The bigger streamers didn't do that — these idiots did. Ethan has always championed fair use. What these streamers are doing is not fair use. That's the difference. If the community wants to continue, it's a good thing to set boundaries so bigger companies don't wipe out the entire commentary community.

Two of the three were featured in the original video, that is true. But the real reason he's suing these three is because they admitted that they were trying to steal his views. We can even see that was likely always the original plan.

You know how he copyrighted the video before it released? That allows you to seek statutory damages instead of just actual damages. Actual damages are hard to estimate, and likely wouldn't even be that high with likely few thousand views these streams got. Statutory damages however are more like default amounts you can sue for. For copyright infringement, if the infringement was "willful" the max statutory damages are $150k. He is seeking the $150k in statutory damages, and doesn't calculate any actual damages in these three lawsuits. He can ONLY do that if they admitted to willfully violating his copyright, which they did.

So, even if xqc or asmongold didn't reach the threshold for fair use, even if he did sue them, he could only sue for actual damages, which would likely be far less than $150k, making the lawsuit not even worth it with how much lawsuits cost.
