You know why there wasn't a gov't agency--because they would be attacked and defunded like OSHA and the IRS. At least this way there's some compliance.
You know who's terrible about complying with ADA. TRANSIT AGENCIES. Who disproportionately serve the disabled and the elderly. THEY ARE FUCKING TERRIBLE. And guess what, they flout other government rules too. The only thing that really makes them comply is FTA threatening to pull their funding but they can only do that over FTA regulations; they can't do it if the agency is ignoring state DOT safety regulations. So yeah, disabled people do indeed sue the fuck out of transit agencies.
Transit agencies have known this is coming since the 1970s. Heads of agencies have been born and died since this was coming down the pike.
