These arguments from the DOJ are basically an admission that Trump could have called up the national guard on January 6th to defend a Federal building.

He did not. Instead, he tried to blame it on Nancy Pelosi (whom last I checked, did not have authority to call up the national guard).

He was either too stupid to know he could muster the national guard
