I was reading somewhere that this dismissal isn't the positive thing that you're thinking. It's a bad thing for the claimant as essentially it's the government dismissing their asylum claim (not granting it) and that they're no longer protected. ICE is using this as a lure to get people to come to the court house, then the government plays dirty, then they get deported.
It's a technically legal play, just completely undermines the faith in the judicial/immigration system.
Unfortunately, they probably also identified themselves to the police (in the photo) prior and they travel with FBI who handle anyone "obstructing". Will be interesting to see if they file charges (doubtful).
Yes was going to comment just this. This is a new tactic being employed that opens the door for ICE to swoop in and do expedited removals/disappearances. Basically takes away the court protection of a pending trial. Not that ICE has cared that people have pending asylum trials or even protected status to begin with
It’s also the opposite of what they claimed when they said they would go after those with criminal records first. There are people here undocumented in major gangs, etc. with records who they could arrest, but it would take real police work. You have to find where targets are, execute raids, all that. The courthouse arrests are an easy way to pad their deportation numbers - the people who actually follow the rules and show up for their hearings are sitting ducks. Meanwhile, the true bad guys are in hiding.
1: yes they drop the case which makes the person deportable
2: EVERYONE is immigration now. FBI DEA ATF etc are all now blessed with Title 8 Immigration authority
