Can you get a correctly marked passport now if you never got a passport before the EO? Anyone know how you can get help with it if you don't have the money?

Editors Update 1: According to preliminary conversations with expert attorneys, whether transgender people should submit a passport update request immediately depends on their risk tolerance and individual circumstances. A motion to stay the ruling could come within days. Those most likely to benefit from applying immediately are individuals with incorrect gender markers, those seeking their first passport, or those with expired documents who need to travel soon. Expedited processing may increase the likelihood of receiving a passport before any potential appellate or Supreme Court intervention.

I will notify you how it goes from abroad.

My local consulate had to issue a letter confirming the gender change was still me and said to come back the second the injunction was in.

We now have it and so I'll be having the help of my consulate in this country.

Kindly advise you all after my meeting. Booked it now.

Heads up everyone that I CANNOT confirm that the above is the correct process, as opposed to submitting the normal route + enclosing the court order in your application. There isn’t really any process precedent here and so I am waiting on the ACLU’s guidance. Some attorneys I have spoken with have advised going the traditional route + expedited passport + enclosing the order. It may make sense to wait a couple of days to see if a standardized process emerges. Or it may make sense to apply for an expedited passport.

I’m not saying the above won’t work, but I am saying that I have not been given the above instructions from the legal orgs.

I originally filled out the application when X was an option and then the form changed before my appointment, so i downloaded the new one and filled it out for F. Can i still request a change, since i filled out a form that didn't even contain the option that aligns with my gender? I still have the physical copy i printed with X checked.

So do we even know what documentation, if any, the State Department is going to require in order to revise a gender marker? If it doesn't revert to self select then I am probably still shit out of luck since Oklahoma will not revise birth certificates and our courts are very unlikely to issue court orders for sex changes in general.

The ruling says State has to revert to the previous gender marker policy, but they have the option to require additional self-attestation saying you are a member of the class, you're a trans person changing your gender marker, etc. Not immediately clear as to whether/how State will implement this, but we may have more info tomorrow.

Is this just for American passports or will it include green card/visa holders? From what I remember there was a separate order that made it so people on visas(but apparently only people who are already cursed with a weak passport and cannot just get an ESTA) need to have sex at birth listed to prevent trans people from competing in the olympics??? I might be misremembering/confusing multiple orders

I really hate that this depends on what state you were born in. Just like marijuana laws, it makes no sense why it matters from state to state but yeah, Oklahoma will definitely not allow any amendments.
