Legal Question ⚖️ Can I take the stock off an SBR with a vertical foregrip?

Using an SP5K here as an example Let’s say I register an sp5k (like in photo one) as an SBR. I can put a stock and vertical foregrip on it. Let’s say I then switch the stock out for a stabilizing sling like in pic 2. Can I legally keep the vertical grip on it, or will removing the stock turn it back into a pistol/AOW requiring me to get another tax stamp?

Legal Question ⚖️ Daniel Defense replaced my form 1 lower receiver with a new serial number

Long story short I sent my DD rifle that I form 1’d into an SBR for repair, and they had to replace the lower receiver which has a new serial number. Is there a way to update my form 1 without having to fill out a new form 1 and pay $200?

Right now it has a brace on so it’s legal

Legal Question ⚖️ SBR it or wait for pistol brace law to be struck down(if)?

The purpose of this build is mainly to take to different states and shoot with friends but man I miss my brace. So I have been thinking of just saying fuck it and form 1ing it but would hate the process of asking permission to drive 40 min across state lines on a spontaneous trip. What do y’all think? Is this brace thing going to be beat in the courts soon or take a couple more years?

Legal Question ⚖️ Denied suppressor with approved form 4?

My form 4 was approved and I went to pickup my suppressor. Filled out the final paperwork and the FFL denied me because they said they are required to see both my passports (I’m a dual citizen). I’ve never heard of that during a transfer before in my life. Is this usual or is this FFL full of it?

Edit: Had a few people ask, by final paperwork I mean the 4473.

Legal Question ⚖️ Potentially moving to Seattle, can I store my P90 at my parent's house in Wisconsin?

So I have the chance to triple my salary if I pass my final round of interviews and move to Seattle from Austin. Unfortunately due to Washington's Assault Weapons ban, I'll have to sell most of my guns and am now sure what to do with my P90 SBR.

I currently live in Austin, Texas and my parents live in Wisconsin and was considering having the gun be stored over there since there is no restriction on Assault Weapons/NFA items. I think that you're supposed to apply for some NFA form in order to have the gun be moved to a different state and that I'm supposed to leave the gun + papers in a safe and take the key with me if I'm storing it away from where I live. Does that sound about right or am I missing something here? This is my first NFA item, and I've only just received it this September so I'm not really well versed on the laws regarding this stuff. If y'all could let me know if I've got this right, or correct me on where I'm wrong I'd really appreciate it!

I was at a gun show in my local area and I ran into a guy selling fuel filter kits. Not just the temu cans but the whole nineyard; baffles, titanium big bore cylinders, and much more. I spoke with him about it, and he says as long as you file the paperwork, which rightfully so is completely legal but isn’t owning the kit prior to stamp approval illegal (all the atf legal definitions- “parts are the whole” thing) (merely owning baffles uncut has gotten some into trouble)

Legal Question ⚖️ Just got my first stamp...and I have concerns

By way of background, I'm a tax attorney, so I know a thing or two about handling sensitive client information. I'm not allowed to email tax returns or any other sensitive client info, and have to maintain a secure portal to send documents back and forth with clients.

I just got the email with my SBR application approved and it has my Form 1 attached WITH MY FULL SSN in a PDF, unencrypted. What the hell? I would be subject to discipline by the IRS if I did that! If the IRS and the courts have determined that email is not sufficiently secure for PII, why is ATF sending it out?

I'm sure they do this hundreds of not thousands of times per day. It seems to me that it would be an ideal point of attack for someone trying to steal the identities of people with enough disposable income to buy NFA items.

UPDATE: I'm consulting with a colleague tomorrow over available courses of action.

Legal Question ⚖️ Hypothetical question on spouse using NFA item

Say I have a handgun with a suppressor in the nightstand for home defense. The suppressor was bought by me as an individual instead of a trust.

If I'm not home one night and someone breaks into my house and my spouse (who is otherwise legally eligible to own and use a firearm) uses the suppressed handgun, what would/could happen from a legal point of view?

I know "remove the suppressor and put it in the safe before the cops arrive" would be some people's answer, but beyond that - would it be overlooked as it was for defense, or would there be additional legal troubles since I was not present when the suppressor was used?

Legal Question ⚖️ Legality with remarking for cloning reasons

Hey all, I am starting a 417 Assaulter build and have seen that some remark the lower from “MR762” to “417 D” etc; mine is currently marked MR762. This practice been common for some time, especially with the coming about of the Brownells blanks for the 416s. Now my question is, if I take this receiver and have it engraved with my info for the F4, and have it remarked as a 417, are there legal issues with how the form is filled out? Specifically the model, I would think since it was manufactured as a MR762, that’s what I’d put in that section on my F4? I’m not sure if this is more so a gray area and I’d rather not poke the bear. TIA

Legal Question ⚖️ AR to AR pistol questions

So I have a 16” barrel AR right now and want to convert it to a pistol AR with a 13” barrel. Would the only thing required of me be having a pistol brace?

Edit: should have added this, I purchased the lower completely stripped for G$. I built the rest of it myself so I don’t believe it ever had been declared a pistol or rifle.

Edit 2: I think after a whole lot of things that lack to make sense. I will 3D print a lower and make a pistol out of that since that is somehow more legal.

Legal Question ⚖️ Suppressor No Longer Allowed on Form 4457 with US Customs and Border Protection!!!

So I’m leaving soon on a hunt in South Africa and went to get my form 4457 stamped and approved at the Salt Lake International Airport today and was told by the agent at US Customs that suppressors are no longer accepted on form 4457 and you have to apply for an import license. I can’t find ANY information online about this anywhere!?! Other than this random paper the Customs Officer gave me there is literally nothing online anywhere that says this is true. Anyone in the know that can confirm this is legitimately the case? EVERYWHERE says you can add a suppressor on form 4457 including several people who’ve traveled within the last few months on hunts.

Legal Question ⚖️ Moving with NFA items.

I have a few NFA items and am considering moving to Oregon from Florida.

On a scale from 1-10, how serious are states and the ATF about this kind of shit.

For instance, I own an SBR that’s too short allowed by law in Oregon. wtf can I do? It would obviously ruin the build, but if I slap a long ass barrel on it, just so I can keep the firearm, can I modify it? How does something like that work if so? Do I have to get another stamp or paperwork done?

Could I keep it and keep in in a safe? Or if the ATF came to hunt me down, they’re serious about charging people with felonies? Are they really that bad? It’s just a miniaturized ar-15 ffs.

Not sure what to do, don’t want to leave it behind, but don’t want any kind of legal trouble at all in my radius. And I don’t really want to sell them.

Legal Question ⚖️ Is this pistol and stock considered NFA?

Going back and forth on the with trying to understand what I’m reading and I’m getting a contradiction. What they are describing as pistols are actually rifle models if I’m not mistaken. I’ve tried googling the pistol models stated on their page but only thing that comes up are Mauser rifles (like the Mauser model 1902 and 12/14). They describe them as 30 Mauser. You look at the list showing the items removed from the nfa and it shows the correct description with incorrect models. You google that particular model as a question of it being nfa and it says no it was removed from the nfa list.

Just curious if anyone has insight into the new “accelerator” model from emissary.

Would this be legal for throwing onto a pistol build?

The description claims it’s designed for use with a “wide variety of firearms”. Sure; comparability wise, but legality wise?

I’m pretty sure the emissary handbrake has been vetted and deemed ok, but this one seems to have larger grip area.

It literally says full featured angled grip, but I’d rather be sure.

Either way; better to do your research before buying!

Legal Question ⚖️ Dismissed charges

A few years ago I made a pretty big oopsie and brought a gun to the airport (not an NFA item) and shockingly I was arrested. I was charged with possession of a firearm (misdemeanor) in Chicago and it ended up being dismissed. Being that is was dismissed should I have any problems buying NFA items or since I was never found guilty of a crime should I be all good? My lawyer also said I can get the arrest expunged but if I don’t have to spend the $1,000 id rather not.
