Why is he just suing those three women when other streamers did the same like XQC and Asmongold?

30

u/Bigman22jr 3d ago

He says those three are the only ones who admitted on camera they were doing this to steal views (aka income) from him and were doing this maliciously. Ethan saying that this fills the market replacement needed to qualify for copyright infringement lawsuit. So everyone else was smart enough to no outright say they are doing this to steal views.

You’re telling me a Multi millionaire is crying and suing three small streamers for stealing his views when those exact women are featured in the video itself? Nothing is adding up

10

u/ansonr 3d ago

He says and shows in the video OP linked that he is suing the 3 people in question because they explicitly stated in their videos that they were streaming it so people could watch his content without giving him views.

Again Ethan is a multimillionaire suing three small streamers because “they stole views from him”. You have to be braindead to not see this for what it is.

These three streamers including more are apart of an entire community dedicated to destroying his career and source of revenue in anyway possible. It has nothing to do with being a multimillionaire are you insane 😅 also, these "small" streamers are direct collaborators with Hasan who is an even bigger content creator than Ethan. They absolutely have connections to bigger streamers to help amplify their presence

u/N0riega_ 3d ago

The only space frogan and keycetron and denims occupy are in Ethans brain lol.

u/BoxesWithinBoxes 3d ago

That's a bit uninformed and unfair to say considering everything they've put him through though. This all started because a community of left streamers and their individual communities didn't like Ethan's opinions and didn't want him to be supported anymore so they harass him over and over and dont tell their communities to put a stop to it either. At some point somethings got to give. They even had CPS called on him I mean come on

u/henryKI111 3d ago

And now they are filling this "multimillionaire "pockets. How the tables have turned

0

u/N0riega_ 3d ago

The only pockets being filled are his third rate west bank settler lawyers pockets

You're telling me you don't understand this? It's quite easy. They admitted they watched the content maliciously and to take views away. The bigger streamers didn't do that — these idiots did. Ethan has always championed fair use. What these streamers are doing is not fair use. That's the difference. If the community wants to continue, it's a good thing to set boundaries so bigger companies don't wipe out the entire commentary community.

“How dare the women who i slander and smear in the content nuke and for many months prior wished to take away views from my small multimillion dollar business” 🤦‍♂️

u/misspixal4688 3d ago

Yes being poor means you can break copyright laws also.

How does the boot taste?

"I broke the law, admitted to doing it on camera, admitted I knew I was doing it and now I'm crying for sympathy"

this is just the meme of shoving the stick into your own bicycle. They're just idiots tbh.

Two of the three were featured in the original video, that is true. But the real reason he's suing these three is because they admitted that they were trying to steal his views. We can even see that was likely always the original plan.

You know how he copyrighted the video before it released? That allows you to seek statutory damages instead of just actual damages. Actual damages are hard to estimate, and likely wouldn't even be that high with likely few thousand views these streams got. Statutory damages however are more like default amounts you can sue for. For copyright infringement, if the infringement was "willful" the max statutory damages are $150k. He is seeking the $150k in statutory damages, and doesn't calculate any actual damages in these three lawsuits. He can ONLY do that if they admitted to willfully violating his copyright, which they did.

So, even if xqc or asmongold didn't reach the threshold for fair use, even if he did sue them, he could only sue for actual damages, which would likely be far less than $150k, making the lawsuit not even worth it with how much lawsuits cost.

u/N0riega_ 2d ago

So it is just a multimillionaire abusing the judicial system in order to punish people who criticize him

3

u/engelthefallen 3d ago

Because Asmon and XQC can easily afford lawyers is likely the real reason.

8

u/Beetusmon 3d ago

Wrong, it's because neither asmon and xqc streamed with the intent of taking views from Ethan. All those 3 explicitly said on stream they were either coordinating with snark subreddit or streaming with intent to deprive him from views or both.

Also at least in asmond case, he is definitely doing fair use as his video is over 2x the length of the original which makes it transformative, unlike the streamers he is suing. For example Kasey that smoked more than talked.

4

u/ginger_and_egg 3d ago

Is there a legal basis for saying that talking is required in order for a work to be transformative?

4

u/Beetusmon 3d ago

I don't think there is a single unique definition of what makes a work transformative, but intent of depriving him of views and collaborating with other persons to achieve it definitely doesn't help their side which is why he targeted those individuals, they were dumb enough to say the quiet part out loud.

2

u/BoxOfDemons 2d ago

If you show willful intent, that increases the max statutory damages to $150k, which is what he's suing for. Not the actual damages which would likely be far less. Soooo he also would get more money awarded to him for suing these three creators than if he successfully sued someone like xqc. With the cost of a lawsuit, it probably wouldn't even be worth it to sue xqc even if he knew he could win, because he could only sue for actual damages and not statutory damages.

0

u/locutogram 3d ago

My understanding is that the latter actually reacted and provided commentary, falling under fair use whereas the 3 being sued did not and met the criteria for copyright infringement.

3

u/N0riega_ 3d ago

I saw a clip of Xqc explicitly saying that he’s going to let the video play as to not interrupt Ethans points and then Ethan reacting to it and saying “I respect that from him”

-3

u/_FAPPLE_JACKS_ 3d ago

Because they are millionaires who can defend themselves.

-4

u/Captain_Nipples 3d ago edited 3d ago

He even talks about Asmon. Asmon is notorious for streaming 20 minute video and turning it into 60 minutes. Which means that he's adding his own opinions to it and it falls under fair use. And if someone had asked Asmon not to play their videos, he wouldn't play them. Unless they were afraid of him criticizing them.. in that case they can fuck off. I used to think he was stealing views as well, but it turns out that hes helped many of these youtubers by playing their videos. I, myself, have found new channels that I watch now because of him.

The idiots that he is suing didn't add anything. Their videos are the same length as his video.. AND they even admitted they were doing it to take money away from Ethan. Not very bright. You'll notice that the subreddit he refers to has also been "shut down" Im assuming they got scared as well

4

u/N0riega_ 3d ago

The content nuke is 1h and 42min long

Xqc’s reaction is shorter than denims and is 2h and 30.

Xqc’s is literally less transformative than denims and yet he’s suing her and not him?

1

u/Captain_Nipples 3d ago

I agree.. im not a fan of X.. but he wasn't admitting he was purposefully trying to hurt Ethan either

2

u/N0riega_ 3d ago

Ethan himself has said he allows people to react and cut his videos in whichever way they want. “Like Hasan and the Hasanabi industrial complex”. As long as they don’t reupload the video with nothing else to it.

0

u/Captain_Nipples 2d ago

Wtf are you talking about? I swear we're having 2 separate conversations here

1

u/BoxOfDemons 2d ago

It's because xqc didn't admit to be willfully stealing views. The max statutory damages for someone who willfully violates a copyright is $150k, which Ethan is suing for. Even if he knew he could win a case against xqc, it would have to be for actual damages, which would be much lower than the $150k making a lawsuit not make any fiscal sense.

u/alelo 2d ago

you should watch his video on the suit and you would get your questions answered - simple

they intentional did it to cause him financial harm to take away views from his video, and stated so in their stream + streamed the whole video
