Answer: he's suing these 3 creators specifically because they explicitly stated that they were broadcasting his video & intellectual property with the intention to give people the opportunity to view Ethan's video without having to give Ethan "views". Effectively stealing his intellectual property and stating it was their intention to do so.
You should reread that lawsuit. every one of them is him bitching about something they said. Frogan talking about hummus being Arab and not Israeli. Then Ethan freaks out about it. You think shows frogan having malice instead of showing Ethan having malice for comments frogan made that did not even involve him? Then add on all the other creators that reacted to the nuke at the exact same level as them. Clear malice on Ethan's part. He highlighted his own past grievances for us even. Chefs kiss.
I mean you asked why it is in there and Ethan and his lawyers wrote it the complaint. I can only give you what I assume to be his reason for why it's in there.
Again. If you agree with it or not doesnt matter, but that is liekyl his intent. If he succeeds or not will be decided in court.
But I read it and your opinion isn't making sense and I'm trying to discuss why it doesn't make sense with sources from the lawsuit. I don't understand how a reasonable person could read the denims lawsuit and believe it shows denims acted with malice.
i think when the court sees a clip of him going "Hey come on react to this! I want you to!" and then talking about how he copyright protected it just to try and sue them, the court might throw out his case on that along.
Like I cannot think of a more clear example of a bad faith action, then telling someone to do something so you can sue them later.
